Rejoinder affidavit filed today, is taken on record. Heard the learned counsel for the parties.
Applicant-plaintiff filed second appeal wherein injunction order came to be passed on 29 August 1988 restraining the respondents from raising any construction or planting any tree over the land in dispute.
Counter affidavit filed on behalf of the first and second opposite party have disputed the contention of the applicant that the injunction order has been flouted. On the contrary, allegation has been made against the applicant.
In view thereof, disputed questions of facts cannot be gone into in contempt jurisdiction.
The contempt petition is consigned to record with liberty to the applicant to take remedy before the appellate court.
