Heard Sri N.S. Kushwaha, Advocate, holding brief of Sri Amit Srivastava, learned counsel for the applicant and Sri Prashant Kumar, learned A.G.A. for the State.
This Application under Section 482 Cr.P.C. has been moved by the applicant with a prayer to direct the court below to hear and decide the Complaint Case No. 1504 of 2015 under Section 138 N.I. Act P.S. Tajganj, District Agra pending before Additional Chief Judicial Magistrate, Court No.3, Agra expeditiously within short span of time.
Learned counsel for the applicant states that the present case under Section 138 N.I. Act was initiated on 9.6.2015, since thereafter, not a single witness has been examined by the court below, hence, a direction may be issued to the court below to the decide the same expeditiously.
It is directed that court below shall make all endeavour to decide this case expeditiously preferably within a period of six months without permitting undue adjournments to either side.
With this direction, this application is disposed of without issuing any notice to O.P. No.2 as it is an innocuous order. If the O.P. No.2 feels aggrieved, he may approach this Court.
