Heard Mr. Ranjan Srivastava, learned counsel for petitioner and learned Standing counsel for the State respondent.
Petitioner in the present case has merely prayed for the following relief:-
"I. Issue a writ order or direction in the nature of Certiorari quashing the impugned order dted 18.7.2013, passed by Tehsildar/Sub Divisional Magistrate, Tehsil- Ghorawal, District- Sonbhadra and allowed the writ petition of the petitioner.
II. Issue a writ order or direction in the nature of mandamus directing the respondents not to dispossess the petitioners over the land in question and decide the representation dated 11.11.2019/24.9.2020 which pending before the District Magistrate/Collector, Sonbhadra / Sub Divisional Magistrate, Tehsil- Ghorawal, District- Sonbhadra, within stipulated period of time."
It is submitted by learned counsel for petitioners that the pursuant to the direction of this Court in WRIT- C No. 69651 of 2011 (Abhushan Brahma Shah And Another Vs State Of U.P. And Others) vide order dated 12.12.2011. Respondent no. 4 passed order dated 14.6.2013 whereby entries made in the revenue record, as prior to declaration of his land as surplus.
The grievance of the petitioner has not been considered, although he filed representation in this regard before competent authority for correction in Khatauni on 11.11.2019. After the said order came into their knowledge, a reminder was sent on 24.09.2020. But nothing has been done by the competent authority.
Learned Standing Counsel submits that no useful purpose would be served in keeping the writ petition pending and an appropriate direction may be issued to respondent no. 5 to consider the grievance of the petitioner.
Considering the facts and circumstances of the case, without going into the merit of the case and with the consent of the parties, the writ petition is disposed of with a direction to respondent no. 5- SDM, Tehsil Ghorawal, District Sonbhadra, to decide the application of the petitioner within a period of six months from the date of production of computerized copy of this order.
The concerned Court/Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall act accordingly without waiting for submission of the certified copy of this order.
