Heard Sri Ram Sharan Giri, learned counsel for the petitioner, Sri Jitendra Shankar Pandey, learned counsel for the respondent No.2, learned Standing Counsel for the State and perused the record.
By means of the present writ petition under Article 226 of the Constitution, the petitioner has sought a direction in the nature of mandamus commanding respondent No.2- Bank for permitting petitioner to operate the savings bank account which was earlier joint account in the name of petitioner along with his father.
Learned counsel for the petitioner states that joint account was in the category of either of the surviver and yet in spite of death of his father being communicated to the bank, the bank is not permitting him to operate the account.
Sri Pandey, learned counsel for the respondent No.2 submits that in case the petitioner approaches the bank and completes the formalities relating to the death of the principal account holder, the appropriate order will be passed looking into the grievance of the petitioner.
In such view of the matter, we are disposing of the writ petition with a direction to the petitioner to approach the bank within a period of two weeks from today along with all documents relating to the death of his father and the bank shall consider the same and do the needful in accordance with law.
