Heard learned counsel for the petitioner and learned Standing Counsel for the State-respondent.
The writ petition has been filed seeking the following relief -
"i. Issue a writ order or direction in the nature of mandamus commanding the respondents to decide the appeal no.1760/8801, (Sahdev Vs. State), under Section 11(1) U.P. Consolidation of Holdings Act including the restoration application."
It has been submitted that an appeal filed by the petitioner under Section 11(1) of the U.P. Consolidation of Holdings Act. Unfortunately, appeal was dismissed for default. A restoration application filed on 20.04.2017 has not been disposed of till date.
Under the circumstances, this writ petition is disposed of directing the Settlement Officer Consolidation to decide the restoration application filed on 20.04.2017, expeditiously, preferably within a period of three months from the date a certified copy of this order is filed before him.
Thereafter, in case occasion arises, the appeal itself may be decided as expeditiously as possible without granting any unnecessary adjournment to any of the parties.
