Heard Shri Arvind Kumar Yadav, learned counsel for the petitioners; Shri Surendra Kumar Pandey, learned Standing Counsel for the State respondents.
Notice need not be issued to the private respondents, in view of the order proposed to be passed.
The petitioners are before this Court with the request to command the second respondent to mutate the name of the petitioners in the revenue record i.e. Khatauni on the basis of sale deed dated 30.06.2012 executed by Manjoor Ahmad s/o Wasid with regard to the extent of 1/3 share i.e. 6.77 hectare of the land Arazi no.943 area 2.031 hectare situated in village Bhudkurahan, Tehsil Shahganj, District Jaunpur in pursuance of mutation Case no.T201214361344 under Sections 34/40 of U.P. Land Revenue Act read with Section 34/35 of U.P. Revenue Code, 2006 within stipulated period and further prayer has been made to decide the aforesaid mutation case also.
Learned Standing Counsel very fairly states that in case the aforesaid case is still pending, the same shall be considered and decided by the Authority concerned expeditiously.
In view of the above, without expressing any opinion on the merits of the case and considering the facts and circumstances of the case, on consent, the writ petition is disposed of finally with a direction to the Tehsildar, Tehsil Shahganj, District Jaunpur to expedite the hearing of the aforesaid case and conclude the same expeditiously, preferably within a period of six months from the date of production of a certified copy of this order before him, without granting unnecessary adjournments to either of the parties, except upon payment of cost but certainly after according opportunity of hearing to all the stake holders in the matter.
