The present writ petition has been filed praying for writ of mandamus commanding the Settlement Officer of Consolidation, New Unit, Sadar, Azamgarh, i.e., respondent no.
5 to transmit the records to the Secretary (Revenue), Uttar Pradesh, Lucknow for considering the plea of the petitioner for exchange of his original gatas with the plots of the Gaon Sabha over which the petitioner is in occupation.
The petitioner may make an appropriate application for the purpose before the Settlement Officer of Consolidation who shall decide the said application expeditiously.
It is clarified that the Court has not adjudicated on the merits of the claim of the petitioner and the right of the petitioner to exchange his plots as pleaded in the writ petition or even the maintainability of any such plea which shall be decided by the Settlement Officer of Consolidation.
With the aforesaid observation, the writ petition is disposed of.
