Heard Sri Anand Kumar Srivastava, learned counsel for the petitioner as well as learned Standing counsel while Sri Azad Khan appears for the Gaon Sabha.
Learned Standing counsel has raised a preliminary objection that the writ petition is not maintainable at the behest of the petitioner who has no right to bring in such a petition for cancellation of the patta granted by opposite party No.2, who has availed the facility for forty to fifty years according to the petitioner himself.
In view of above, the writ petition is not maintainable, hence dismissed, however, with liberty to the petitioner to approach appropriate authority if the procedures in accordance with Revenue Code are maintainable. The ground of limitation may also be seen there.
