Heard learned counsel for the applicant and learned AGA for the State.
By means of the present application the applicant has invoked the inherent jurisdiction of this Court to direct the court below to expeditiously disposal of the case no. 2150 of 1994 under Sections 409, 420, 218 IPC, P.S. Kotwali, District Deoria.
Learned counsel for the applicant submitted that the applicant retired from service in the year 1997, the present criminal case is pending before CJM, Court No.11, Deoria with regard to case no. 2150 of 1994.
From the order sheet it is clear that the matter is pending since 1994, the applicant is old man is an accused of almost 80+ years and on account of this criminal prosecution he has not been able to receive his post retiral benefits.
Under the circumstances it is expected from the C.J.M. concerned would decide and conclude the matter within a period of one year from the date of production of certified copy of this order without granting unnecessary adjournments to either of the parties.
With the aforesaid observation this application is disposed of.
