Heard Sri S.K. Rai, holding brief of Sri Ratnesh Kumar Singh, learned counsel for the applicant.
The present contempt application has been filed for punishing the opposite party for willful disobedience of the judgment and order dated 30.10.2013 passed by this Court in Writ A No. 60115 of 2013 (Ram Ashish Rai Vs. State of U.P. and Others) by which this Court has directed the opposite party to consider and decide the applicant's application by a reasoned and speaking order within four months from the date of production of a certified copy of the order.
It is stated in para 10 of the affidavit filed in support of the contempt application that the applicant has served the certified copy of the judgment and order dated 30.10.2013 passed by this Court in Writ A No. 60115 of 2013 in the Office of the opposite party on 11.11.2013, but no decision has yet been taken, even after the expiry of four months.
Prima facie, a case has been made out for willful disobedience of the judgment and order dated 30.10.2013 passed by this Court in Writ A No. 60115 of 2013. However, no notice is issued at this stage and the opposite party is granted two months further time to take decision in the application of the applicant from the date of receipt of certified copy of the order of this Court.
In case the opposite party does not comply with the judgment and order dated 30.10.2013 passed by this Court in Writ A No. 60115 of 2013 and the order of the date passed in the present application within the aforesaid period, it will be open for the applicant to approach this Court again.
With the aforesaid observations, this application is finally disposed of at this stage.
