Heard learned counsel for the petitioner, learned standing counsel for the State-respondents and Sri Deo Dayal, learned counsel for the respondent Nos.2 and 3.
The impugned order dated 07.07.2018 withholding the salary of the petitioner has been passed without considering the reply of the petitioner dated 04.06.2018.
Learned counsel for the petitioner submits that the petitioner is being harassed for no fault on his part.
Learned counsel for the respondent Nos.2 and 3 states that the respondent No.2 shall pass an order afresh in accordance with law within a time bound period, after due consideration of the reply submitted by the petitioner.
In view of the aforesaid, the impugned order dated 07.07.2018 is hereby quashed. Respondent No.2 is directed to pass an order afresh strictly in accordance with law, after considering the reply of the petitioner, expeditiously, preferably within four weeks from the date of presentation of a certified copy of this order, after affording reasonable opportunity of hearing to the petitioner.
The writ petition is disposed of with the aforesaid direction.
