Heard learned counsel for the parties.
The petitioner has retired as Pump Operator from UP Jal Nigam, Varanasi on 30.04.2021 and he has has prayed for following relief:-
"(i) issue a writ, order or direction in the nature of Mandamus commanding the Respondents No.2 & 3 to pay the entire retiral dues i.e. Leave Encashment amount Rs.4,12,630/- +Gratuity+Dearness Allowance 136% Rs.3246/- + 139% Rs.1624/- + 142% Rs.812/- and 148% Rs.4180/-, 154% & 164% etc. and other amount alongwith interest in accordance with law of Hon'ble Apex Court."
The grievance of the petitioner is that neither the respondent no.3 has considered his representations nor has passed any order for payment of aforesaid due amount.
Learned Standing Counsel submits that no useful purpose would be served in keeping the writ petition pending and appropriate direction may be issued to respondent no.3 to consider the grievance of the petitioner.
Considering the facts and circumstances of the case and without going into the merits of the case and with the consent of the parties, the writ petition is disposed off with liberty to the petitioner to file a fresh representation before the respondent no.3-Executive Engineer, 6th Construction Division, Rural U.P., Jal Nigam, Varanasi, raising all his grievances within a period of two weeks from today. In case any such representation is filed by the petitioner, the respondent no.3 shall consider and decide the same by reasoned and speaking order within a period of two months thereafter.
The writ petition is disposed of subject to the observations made above.
