Heard learned counsel for the petitioners, learned A.G.A for the State of U.P. and perused the record.
Under challenge is the F.I.R. relating to case crime No.1396 of 2009, under sections 3/5/8 Prevention of Cow Slaughter Act & section 307 IPC.Police station -Kotwali Bikapur district- Faizabad.
The FIR discloses commission of a cognizable offence therefore, it cannot be quashed.
Learned counsel for petitioners submits that the petitioners are not named in the FIR and the arrest of even the main accused, namely , Akbar Ali has also been stayed by this court vide order dated 9.12.2009 passed in writ petition No. 11395 (Misc. Bench) of 2009, Annexure- 3.
In view of the above, this petition is finally disposed of with an observation that petitioner shall not be arrested in the aforesaid case crime number unless and until credible and cogent evidence is collected against them during the course of investigation, subject to their full co-operation.
