Heard learned counsel for the petitioner as well as learned Standing Counsel appearing for the State respondents and perused the record.
Present petition has been filed with following prayer:-
"(i) Issue a writ, order or direction in the nature of mandamus commanding and directing the respondent no.2 i.e. Tehsildar, Tehsil- Nautanwa, District- Maharajganj to decide the restoration application dt.25.7.2006 for recalling the order dt. 22.06.2004 passed in mutation case no. T201805470304385 (Ram Ugrah vs. Ram Bachan and others) Under Section 34 of U.P. Land Revenue Act, (Now U.P. Revenue Code 2006), pending in the court of respondent no.2 since 25.7.2006, within stipulated period fixed by this Hon'ble Court.
(ii) Issue any other writ, order or direction which this Hon'ble Court may deem fit and proper in the circumstances of the case.
(iii) To award cost of the petition in favour of the petitioner."
In the facts and circumstances of the case, the present petition is finally disposed of with the direction to the respondent no.2 to expedite the hearing of the aforesaid case and decide the same on its own merit, in accordance with law, expeditiously preferably within a period of two months from the date of production of self-verified copy of this order, provided there is no legal impediment and no unnecessary adjournments shall be granted to the parties and provided the functioning of the court concerned is not affected due to any reason related to COVID- 19 Pandemic as well as the lawyers are not abstaining from the judicial work.
With the aforesaid observations/ directions, the present petition is finally disposed of.
