JUDGMENT / ORDER

Hon'ble Vedpal,J.
Heard learned counsel for the petitioners and learned Additional Government Advocate.
The present writ petition has been filed against lodging of First Information Report relating to case crime no. 214 of 2010 under Sections 420, 506, 448 & 511 IPC of Police Station Chinhat District Lucknow.
We have gone through the contents of the First Information Report. It appears that the dispute between the parties is with respect to possession of certain portion of a house.
Submission of learned counsel for the petitioner is that the petitioner has got nothing to do with said portion of the house belonging to the complainant and at no point of time,the petitioner ever intended to take forcible possession of said portion of the house belonging to the complainant.
Let the things be as they are, since the allegations made in the First Information Report disclose commission of cognizable offence, as such, the same cannot be quashed.
Considering the above submissions made by the learned counsel for the petitioners, it is directed that thepetitioners shall not be arrested in the above mentioned case crime number until reliable and cogent evidence comes forward against them provided they cooperate in the investigation which shall go on.
Subject to the above observations, the writ petition is finally disposed of.
