Heard learned counsel for the appellants and Sri Shashi Prakash Rai , learned counsel for the respondent.
Instant appeal has been filed against the award and decree dated 31.3.2010 passed by the Additional District Judge, Court No.13, Varanasi in Land Acquisition Reference No. 85 of 1998, under Section 18 of Land Acquisition Act.
Learned counsel for the parties submit that present appeal is squarely covered by the decision of this Court rendered in Varanasi Development Authority vs. Ram Charitar & another (First Appeal No. 829 of 2003) along with batch of the appeals, therefore, it may be decided in terms of the aforesaid decision.
Accordingly, first appeal is allowed in terms of the decision of this Court rendered in Varanasi Development Authority vs. Ram Charitar & another (First Appeal No. 829 of 2003) along with batch of the appeals.
