R.Alagarsamy vs Mr.C.Varadharajan

Madras High Court|07 December, 2009

JUDGMENT / ORDER

This contempt petition has been filed by the petitioner, praying that this Court may be pleased to punish the respondent for the willful disobedience of the order passed by this Court, on 16.02.2009, made in W.P(MD)No.1262 of 2009
2. By an order, dated 16.02.2009, this Court had directed the second respondent to pass appropriate orders, on merits, on the representation submitted by the petitioner, within a period of four weeks thereafter.
3. The petitioner had submitted that the direction issued by this Court had not been obeyed and therefore, he had preferred the present contempt petition.
4. At this stage of the hearing of the contempt petition, the learned counsel appearing on behalf of the respondent had submitted that the respondent had passed an order, dated 30.11.2009, in Na.Ka.No.R3/1485/09, rejecting the request of the petitioner, on merits.
5. In such circumstances, since no further orders are required and necessary in the present contempt petition, the contempt petition stands closed. However, it is open to the petitioner to challenge the proceedings of the respondent, dated 30.11.2009, in the manner known to law.
vsn To Mr.C.Varadharajan, Personal Assistant to the Collector of Virudhunagar, Noon-Meal Scheme, Collector's office, Virudhunagar.
