The petitioner is permitted to correct the title of respondent no.3 to read as Executive Engineer, P.W.D. (Construction Division), Farrukhabad today itself.
Heard Sri Sumit Suri holding brief of Sri Nipun Singh, learned counsel for the petitioner and the learned Standing Counsel for the State-Respondents.
The petitioner in the writ petition is seeking a direction to the respondents to release his salary for the period from February, 2016 to 12.07.2016.
From Annexure-13 to the writ petition we find that the Superintending Engineer, P.W.D., Lucknow through his letter dated 30.09.2016 had directed the Executive Engineer, P.W.D. (Construction Division), Farrukhabad to examine the claim of the petitioner and pass appropriate orders. It is not known whether any such order has been passed or not.
We, therefore, dispose of this writ petition with a direction to the respondent no.3, Executive Engineer, P.W.D. (Construction Division), Farrukhabad to take a decision with regard to the claim of the petitioner particularly in the light of the letter of the Superintending Engineer, P.W.D. Lucknow dated 30.09.2016 in accordance with law within a period of two months from the date a certified copy of this order is received in his office.
