JUDGMENT / ORDER

Petitioner's vehicle bearing registration No.KL-45-B- 2496 has been seized alleging transportation of river sand without valid permit. The petitioner seeks release of the vehicle under Section 23 A of the Protection of River Banks and Removal of Sand Act. The petitioner has an alternate remedy before the competent jurisdictional Magistrate.
Therefore, the Sub Inspector of Police shall report seizure of the vehicle befoe the competent jurisdictional Magistrate within one week. If the petitioner moves an applicatin for the interim custody of the vehicle, the same shall be considered by the competent jurisdictional Magistrate within a period of ten days from the receipt of such application. The Sub Divisional Magistrate is directed to conclude the proceedings regarding confiscation of vehicle within two WP(C).No.33119/2014-L.
2 months from the date of receipt of a copy of this judgment after hearing the petitioner.
The Writ Petition is disposed of as above.
