1. Heard Sri Sudhir Kumar Chandraul, learned counsel for applicant and learned A.G.A. for State.
2. This bail application has been moved by accused-applicant for enlarging him on bail in Case Crime No.59 of 2017 under Sections-498-A, 304-B IPC and Section 3/4 of D. P. Act, Police Station-Gouribazar, District-Deoria.
3. Applicant is husband of deceased and his marriage with deceased was solemnized on 19.04.2016 and within less than one year, the incident had taken place on 27.02.2017. It is contended that information was given by applicant to family members of deceased but FIR shows that police was informed by Informant and FIR has also been lodged by sister of deceased and neither by applicant nor by his family members. Cause of death is hanging has been fortified by Post Mortem Examination report, which is Annexure 4 to this application. As per FIR version incident has taken place at the residence of applicant but there is nothing to show that applicant and his family members were not present at the house at the relevant time of incident.
6. In the circumstances, I do not find it a fit case for grant of bail.
7. Application is, accordingly, dismissed.
