Heard learned counsel for the petitioners; learned A.G.A. for respondents 1, 2 and 3; and perused the record.
The instant petition seeks quashing of the First Information Report dated 18.1.2019 registered as Case Crime No. 34 of 2019, under Section 307, I.P.C., at Police Station -Line Bazar, District - Jaunpur.
The allegation in the First Information Report is that the accused persons including the petitioners have fired at brother of the informant, as a result, the informant's brother suffered injuries on his leg. There appears to be an injury report also on record.
The learned counsel for the petitioners submits that just to falsely implicate the petitioners, a false and fabricated injury report has been created for the purpose of harassing the petitioner.
It is well settled legal principle that the defence of the accused cannot be considered at this stage.
Under the circumstances no case for interference is made out. The petition is dismissed.
