1. Heard learned counsel for the applicant and learned A.G.A. for the State.
2. This anticipatory bail application has been filed on behalf of the applicant - Rakesh, seeking anticipatory bail in Case Crime No. 0051 of 2021, under Sections - 272, 273, 420 I.P.C. and Section 60(A) Excise Act, Police Station -Etmadpur, District - Agra, during pendency of trial.
3. Learned counsel for the applicant submits that the applicant has been falsely implicated in this case as nothing has been recovered from the possession of the applicant.
4. On the other hand, learned AGA points out that there are serious allegations against the applicant of trading spurious/illicit liquor.
5. That objection apart, keeping in mind the nature of fact allegation involving illicit trade in liquor, no ground is made out for grant of anticipatory bail at this preliminary stage.
6. Accordingly, the present anticipatory bail application is rejected, leaving it open to the applicants to apply for regular bail, which application when filed may be considered, on its own merit as expeditiously as possible, without being prejudiced by any observation made in this order.
