Heard learned counsel for the petitioner and the learned Standing Counsel representing the State-respondents.
In view of the proposed order, the requirement of issuance of notice to the respondent No.5 is hereby dispensed with.
The petitioner is said to be working as adhoc Assistant Teacher, Maths at Ram Nath Inter College, Rujhai, District-Unnao and is claiming his regularization under the provisions contained in Section 33-G of the U.P. Secondary Education Services Selection Board Act, 1982 as inserted on 22.03.2016 by enacting U.P. Act No. 7 of 2016. The matter relating to the claim of the petitioner for regularization is said to be pending before the Joint Director of Education, Lucknow Region, Lucknow.
Accordingly, this writ petition is finally disposed of with the direction to the Joint Director of Education, Lucknow Region, Lucknow to consider the claim of the petitioner in accordance with law and after determining the eligibility and entitlement to be regularized under Section 33-G of the aforesaid Act and pass appropriate order thereon. The Joint Director of Education, Lucknow Region, Lucknow shall call upon appropriate report and documents from the office of District Inspector of Schools, Unnao as also from the Committee of Management of the institution concerned. The aforesaid exercise shall be completed and final decision into the grievances of the petitioner shall be taken by the Joint Director of Education, Lucknow Region, Lucknow within a period of three months from the date of production of certified copy of this order and the decision thereof be communicated to the petitioner forthwith.
