Heard Sri Vivek Tripathi, Advocate holding brief of Sri Amit Kumar Srivastava, learned counsel for the applicants, Sri Suneel Rai, learned counsel for opposite party No. 2 and learned Additional Government Advocate appearing for the State-opposite party.
The present application under Section 482 Cr.P.C. has been filed to quash the proceedings of Complaint Case No.2305 of 2006, under Section 419, 420, 120B, 467, 468, 470 and 471 I.P.C., P.S. Kotwali Chandauli, District Chandauli, pending in the court of Chief Judicial Magistrate, Chandauli.
The matter is old.
Learned counsel for applicants says that applicants are not in touch and he has no instructions at the present moment.
Since learned counsel for applicants has no instructions accordingly, the case is dismissed for want of prosecution.
However it is open to learned counsel for applicants to move appropriate application in future, in case cause of action survive.
Interim order, if any, stands vacated.
