Heard learned counsel for the petitioner and learned A.G.A. for the State.
Learned counsel for the petitioner has drawn the attention of the Court to the order dated 12.11.2018 passed by another Bench of this Court in Criminal Misc. Writ Petition No.31591 of 2018 (Mukesh Saroj vs. State of U.P. and Others) which has been passed with regard to Case Crime No.8 of 2018. Submission is that the facts and legal situation being similar the petitioner is also liable to the same relief as has been granted in the aforesaid case.
Contentions raised at the bar require detailed hearing on law and facts both.
Notice on behalf of opposite party No.1, 2 and 3 has been accepted by learned AGA.
Learned A.G.A. may file counter affidavit within three weeks after the service. Rejoinder affidavit may be filed within two weeks thereafter.
List this matter immediately after expiry of the aforesaid period before the appropriate bench.
Till the next date of listing further proceedings of impugned notice dated 13.09.2018 issued by Addititional District Magistrate, Kaushambi, under section 3/4 of U.P. Gundas Act, in case no.0201802420000765 (State vs. Rakesh Saroj), Kaushambi with regard to petitioner namely Rakesh Saroj, shall remain stayed.
