The record contains a counter affidavit filed on behalf of the State by Sri Martand Prakash Singh, said to be Circle Officer Mishrikh, district- Sitapur, wherein in paragraph-4 it has been stated that in the case relating to case crime number 1067 of 2008 under Sections 147,342,324, 323, 504 /506 IPC read with Section 3(1)(10) S.C/S.T. Act, Police Station Sandana, district Sitapur after investigation no evidence was found against the petitioner Rakesh and his involvement in the case has not been found, as such, no charge-sheet has been filed against him. In view of what has been stated above the writ petition has become infructuous and is accordingly dismissed. Interim order, if any, stands vacated.
