A short counter affidavit has been filed by Sri Nipun Singh, Advocate. In paragraph 4 of the affidavit, it is stated that M/s R. Nagpal Associates has submitted its valuation report before the Company law Board on 18.2.2011 and further proceeding is going on before the Board.
Learned counsel for both the parties agreed that in the circumstances, the order dated 2.11.2010 passed by the Company Law Board, New Delhi Bench New Delhi may be set aside.
In view of the above and facts stated in the order dated 25.11.2010, the order dated 2.11.2010 passed by the Company Law Board, New Delhi Bench New Delhi is hereby set aside. The Board is directed to proceed further in accordance to law.
The appeal is accordingly disposed of.
