Heard learned counsel for the petitioner, learned Standing Counsel for respondent nos. 1 and 2 and Sri Chandrakesh Rai, learned counsel for the respondent nos. 3 and 4.
Learned counsel for the petitioner submits that the controversy involved in the present petition is squarely covered with the judgment of this Court in Writ-A No. 4714 of 2019 ( Sumit and 14 others vs. State of U.P. and 2 others) along with other connected matters, which was allowed vide order dated 8.5.2019, therefore, this petition may also be allowed on the same terms and conditions.
The contention raised by learned counsel for the petitioner has not been disputed by learned Standing Counsel and Sri Chandrakesh Rai, learned counsel for the respondent nos. 3 and 4 on the basis instruction received and they fairly conceded that the matter is squarely covered with the judgment in the matter of Sumit (supra).
Accordingly, this writ petition is allowed in terms of the order dated 8.5.2019 passed in Writ-A No. 12616 of 2019.
It is made clear that in case, competent authority is of the view that the case of the petitioner is not covered with the aforesaid judgement, they shall pass reasoned order within three weeks from the date of production of certified copy of this order.
