Heard learned counsel for the applicant and learned A.G.A for the State as also perused the record.
This application under Section 482 Cr.P.C. has been filed seeking direction to the court below for early decision of Case No. 4365/9 of 2010 (State Vs. Sardanand Sarswati and others), arising out of Case Crime No. 40 of 2006, under Sections- 420, 467, 468, 471, 120-B I.P.C., Police Station- Vrindavan, District- Mathura.
It has been fairly brought on record that the proceedings in the trial had been stayed vide order of this Court passed in Application U/S 482 No. 25919 of 2011. However, it is stated, at present there is no stay order operating in favour of the opposite party.
In view of the above, no direction is required to be issued, at this stage. However, it is expected that the learned Court below may proceed in accordance with law.
The present application is dismissed with the aforesaid observation.
