Heard Sri Ashwini Kumar Srivastava, learned counsel for the petitioner, learned standing counsel for respondent no.1 and Sri Sanjay Mishra for respondent nos.2 to 4.
The petitioner has challenged the suspension order dated 13.2.2019, passed by respondent no.3. From perusal of the impugned suspension order, it appears that a preliminary inquiry was held in which it was found that amount of Rs.7,73,257/- was retained by the petitioner after recovering the said amount from the consumers.
Sri Sanjay Mishra, learned counsel for the Corporation submits that there is no illegality in the order passed by the Executive Engineer.
In view of the above, I find no illegality in the order dated 13.2.2019. However, it is expected that respondent authorities shall conclude the disciplinary proceedings within four months from the date of production of a certified copy of this order. Needless to say that respondent Corporation shall pay subsistence allowance to the petitioner during the suspension period.
Writ petition stands dismissed.
