Pursuant to the orders passed on the previous occasion, learned Standing Counsel has obtained instructions, according to which, petitioner had secured 173.83 marks by the conclusion of first stage, which was below 191.6 marks required for a candidate to be called for physical efficiency test.
It is also stated that at the first stage, no separate merit is drawn for horizontal reservation category and as the petitioner failed to qualify the first stage, itself, therefore, his claim has not been considered.
In the facts and circumstances, this Court finds no error in the action of respondents in denying him consideration.
Writ petition is dismissed, accordingly.
