Heard Sri Tarun Kumar Tripathi, learned counsel for the petitioner and Sri B.N. Singh, learned counsel for the Union of India.
The petitioner is challenging the recovery citation dated 11.01.2019 whereby a sum of Rs.4,83,953.88 plus other charges are being sought to be recovered from him as the amount outstanding against the loan advance to the petitioner under a State sponsored scheme.
Learned counsel for the petitioner submits that the petitioner is ready and willing to make the entire payment without disputing the amount sought to be recovered, provided the some reasonable time is allowed and instalments are fixed.
In view of the aforesaid facts and circumstances, in the interest of justice, we dispose of the writ petition with the direction to the petitioner to deposit a sum of Rs.83,953.88 within a period of one month from today and the balance amount of Rs.4,00,000/- in four equal monthly instalments of Rs.1,00,000/- each payable in the month of October, 2019, November, 2019, December, 2019 and January, 2020.
In the event of default in payment of any instalment the benefit of this order would come to an end automatically.
Accordingly, the Writ Petition is disposed off.
