This is utterly misconceived petition. Grievance of the petitioner is that since petitioner's father had donated 16 bigha land for establishment of a school by way of a gift deed to the State authorities, therefore, petitioner be given compassionate appointment. It is stated that the then Chief Minister had given an assurance that if such land is given the authorities would consider grant of compassionate appointment to family members.
Admittedly, the gift deed has been executed in the year 1989. The gift deed by its very nature does not involve any consideration and the petitioner cannot claim anything in return for the land given as gift. There is no material to show that any such assurance was extended for providing compassionate appointment. No policy of the State is otherwise shown under which such appointment could be claimed. The father of petitioner who had given the land as gift never came forward with any such claim. After expiry of thirty years the petitioner cannot be permitted to raise any grievance that because his father had given certain land as donation, therefore, petitioner be given compassionate appointment. The claim being utterly misconceived has rightly been rejected by the authorities. No other ground is pressed.
Writ petition is, accordingly, dismissed.
