JUDGMENT / ORDER

Hon'ble Yogendra Kumar Sangal,J.
Heard learned counsel for the petitioner and learned Additional Government Advocate.
Under challenge in the instant writ petition is FIR relating to Case Crime No. 291 of 2009, under Sections 419, 420, 467, 48 & 471 IPC, police statin Aminabad, district Lucknow.
We have gone through the contents of the FIR and other documents annexed hereto.
Since the FIR discloses commission of cognizable offence, the same cannot be quashed.
The writ petition is misconceived and is accordingly dismissed. However, seeing that since the dispute, which emerges out from the FIR, is with respect to sanction of loan and payment thereof, we hereby direct that the petitioner shall not be arrested in the aforesaid case crime number unless and until cogent and reliable evidence comes forward against him in the shape of report under Section 169/173 Cr.P.C., provided he cooperates with the investigation, which shall go on.
