JUDGMENT / ORDER

Heard learned counsel for the petitioner and Ms. Deepshikha, learned Addl. Chief Standing for the opposite party No. 1.
In view of the order proposed to be passed, notices to opposite party Nos. 2 and 3 are dispense with.
The present writ petition has been filed by the petitioner for seeking a direction thereby commanding the opposite party No. 1 to decide the Case No. T-201808150501529 [Narendra Tiwari & others v. Suryapal Singh & others], Under Section 34 of the Land Revenue Act pending in the Court of Tehsildar, Tehsil Payagpur, Distict Bahraich.
The submission of learned counsel for the is that the petitioner has filed the aforesaid case under Section 34 of the Land Revenue Act before the opposite party No. 1 on 17.05.2018 and the same has not been decided till date.
Further submission of learned counsel for the petitioner, on the basis of the order sheet placed on record as Annexure No. 8 to the writ petition, is that the reply to the objection has been filed by the contesting opposite parties before the opposite party No. 1 on 24.08.2018 and for the purposes of argument, the date was fixed on 27.09.2018 but till the date, the same has not been disposed of.
In view of the above, the prayer is to direct the opposite party No. 1 to decide the aforesaid case expeditiously.
To the aforesaid prayer of the learned counsel for the petitioner, learned counsel for the opposite party No. 1 has no serious objection.
Keeping in view the facts and circumstances of the case, the writ petition is finally disposed of with a direction to the opposite party No. 1 to make an endeavour to decide the pending Case No. T-201808150501529 [Narendra Tiwari & others v. Suryapal Singh & others], Under Section 34 of the Land Revenue Act pending in the Court of Tehsildar, Tehsil Payagpur, Distict Bahraich expeditiously say within a period of six months, if possible, from the date of production of certified copy of this order and while deciding the same, the opposite party No. 1 shall provide reasonable opportunity of hearing to the party concerned, as per Law.
