Heard learned counsel for the petitioner; the learned Standing Counsel for the respondent no.1; Sri Shiv Badan for the respondent nos. 2 and 3; and perused the record.
The present petition has been filed assailing an order of the Vice- Chancellor dated 15.02.2018 by which he has accorded recognition to the fourth respondent in exercise of his power under Section 2(13) of the U.P. State Universities Act, 1973.
It is not in dispute that against the order of the Vice-Chancellor, a reference application would lie before the Chancellor under Section 68 of the U.P. State Universities Act, 1973.
Under the circumstances, as there is an alternative remedy available to the petitioner, this Court declines to entertain this petition on the ground of availability of an alternative remedy and leave it open to the petitioner to file a reference application before the Chancellor. If any such reference application is filed, the same shall be accorded expeditious consideration by the Chancellor.
