Heard learned counsel for the petitioner and the learned Standing Counsel appearing on behalf of respondents no. 1 to 3.
The petitioner's grievance had already been taken note of by the respondent no. 3 (District Assistant Registrar, Cooperative Societies Mathura) who has written to the respondent no. 4 (Secretary, Atma Nirbhar Sahkari Samiti Ltd., Bharatia Block Baldev, District Mathura) with regard to non-payment of certain dues of the petitioner while he was working as an employee/Accountant with the respondent's Cooperative Society.
The learned counsel for the petitioner has pointed out the letter dated 19.07.2017 sent by respondent no. 2 to the respondent no. 4. He says that till date no action has been taken by the Society for payment of dues of the petitioner.
The petitioner has already made a representation in this regard and the Secretary of the Society has alleged that such payment has already been made to the petitioner, although no such payment has actually been made.
In the opinion of the Court, the grievance of the petitioner can more appropriately be decided by the Registrar Cooperative Societies.
Accordingly, the present writ petition is disposed of with a direction to the petitioner to make a representation to the Registrar Cooperative Societies, within a period of two weeks from today along with a certified copy of this order.
In case such representation is filed before the Registrar, he shall seek a report from the respondent no. 3 with regard to the allegation made by the petitioner and also give an opportunity of hearing to the respondent no. 4 and pass reasoned and speaking orders thereon strictly in accordance with law, within a period of twelve weeks thereafter.
