Heard the learned counsel for the petitioner who has approached this Court seeking expeditiously disposal of the petition preferred by the petitioner under Section 372 of the Indian Succession Act said to be pending before the Court of Civil Judge (Junior Division) South, Court No.24, Sultanpur registered as Miscellaneous Case No.15 of 2019.
The learned counsel for the petitioner submits that it is an uncontested matter where the paper citation has already been issued. No objection has been filed and at one point of time the matter was also referred to the Lok Aadalat, however, the same has yet not been decided.
Be that as it may, since the proceedings are of the summary nature, this Court is of the opinion that no gainful purpose will be served in keeping the aforesaid petition pending, hence without entering into the merits, ends of justice can be served by directing the Civil Judge (Junior Division), Court No.24, Sultanpur to consider and decide the Miscellaneous Case No.15 of 2019 pending before it as expeditiously as possible provided there is no other legal impediment in doing so preferably within a period of three months from the date of copy of this order is placed before the court concerned. .
Accordingly, the petition stands disposed of.
