As per office report dated 28.4.2018, notice issued to O.P. No. 2 has been received back after service but no one has appeared on behalf of O.P. No. 2 to contest the present revision.
Heard Sri Kumar Vinay Singh, Advocate holding brief of Sri Krishan Yadav, learned counsel for revisionist.
The opposite party No. 2, Pramod Kumar who is a public servant, has lodged the first information report against the revisionist. The co-accused, Dr. Akhilesh Kumar Chaudhary in the connected Criminal Revision No. 2380 of 2017, has been dismissed by this Court today and the impugned order which has been challenged, was a subject matter of the present criminal revision also, hence we are not inclined to interfere in the present revision.
We have gone through the revision along with affidavit filed in support of this revision as well as the impugned order and we do not find that the impugned order suffers from any illegality or infirmity requiring any interference by this Court. We find no merit in the present revision as such while dismissing the application u/s 5 of the Limitation Act, we dismiss the present revision against the impugned order.
