Supplementary affidavit filed today is taken on record.
Heard Sri Vinay Kumar Nigam, learned counsel for the petitioner.
The sole prayer in the present petition is for a direction to the Judge Small Cause Court/Civil Judge (Senior Division), Jalaun to proceed and decide the JSCC Execution Case No. 03 of 2009 (Babu Ram @ Babu Lal vs. Kallu @ Kalu Ram and others) expeditiously.
The counsel for the petitioner has referred to the order sheet of the case, a copy whereof has been filed along with the petition and also along with the supplementary affidavit to submit that although dates are being fixed but for some reason or other the proceedings are being adjourned, and the delay in disposal of the execution case is causing undue hardship to the petitioner.
In view of the aforementioned facts and circumstances, the present petition is disposed of with an observation that in case the petitioner appears in the pending proceedings and does not seek any unnecessary adjournment it is expected that the court concerned would make an endeavour to decide the aforesaid execution case expeditiously in accordance with law provided there is no other legal impediment.
