Rakesh And 2 Others vs Sri Narendra Kumar Singh, ...

High Court Of Judicature at Allahabad|05 November, 2014

JUDGMENT / ORDER

Heard learned counsel for applicants.
The grievance of the applicants is that the opposite party-contemnor has willfully and deliberately flouted the order of the Writ Court dated 6.8.2014 passed in Writ C No. 40537 of 2014, copy of which order has been filed as annexure-1 to the affidavit accompanying this application whereby the writ Court had directed the parties to maintain status quo with regard to the suit property.
It is contended that the aforesaid order was duly served upon the respondent no. 2 as is evident from Annexure-6 to the contempt petition which also contains the order of the C.D.O. dated 13.8.2014. It is contended that opposite party no. 2 is illegally interfering to the possession of the petitioner.
Let a copy of this contempt petitioner be served on Addl.Chief Standing Counsel durig course of the day , who may seek instruction within three weeks.
List thereafter.
