This Civil Miscellaneous Appeal arises out of Order, dated 13-05-2014, in IA.No.83 of 2014 in OS.No.413 of 2014 on the file of the Court of the XXV Additional Chief Judge-cum-Vacation Judge, City Civil Court, Hyderabad (for short ‘the lower Court’).
At the hearing, Mr.P.Shiv Kumar, learned Counsel for the appellants, has not disputed that the order impugned in this appeal is an ad interim injunction order and that a counter-affidavit has already been filed by his client before the lower Court.
Having regard to the fact that the impugned order is only an ad interim injunction order, I do not intend to examine its legality. The applicant is permitted to file an application for vacating the said ad interim injunction order. In such event, the lower Court shall dispose of the same as expeditiously as possible.
Subject to the above observation, the Civil Miscellaneous Appeal is disposed of.
As a sequel, CMAMP.No.1212 of 2014, filed by the appellants for interim relief, is disposed of as infructuous.
