All the noticed respondents shall file their replies on this petition within a period of six weeks'.
Post thereafter before the appropriate Court. Matter shall not be treated as part heard or tied up to this Court.
Order on Civil Misc. Stay Application No.1 of 2020:
Learned counsel for the petitioner placing reliance upon an interim order passed in Amar Singh and Another Vs. State of U.P. and 4 others (Writ - A No.-9461 of 2019), prays for stay of the order of termination. The Court at the very outset notes that the learned Judge in Amar Singh has not recorded any reasons prima facie or otherwise in support of the order passed staying an order of termination which itself is based on an allegation of forged testimonials having been used for the purposes of seeking employment. The Court also does not find any merit in the submission that the findings of forgery have been returned merely on the ground that the testimonials could not be verified from the website. As is ex facie evident from a reading of the impugned order, the reason assigned by the respondents for holding the mark sheet of the petitioner to be forged and fabricated is on account of not being verifiable from the record.
The stay application is rejected.
