Certified copy of the order-sheet has been filed today, the same is taken on record.
Heard Sri Hari Nath Chaubey, learned Counsel for the applicants and Manuraj Singh, learned A.G.A. for the State respondents.
It is contended by learned Counsel for the applicants that the applicants are resident of other State and they have been falsely implicated in the present case. The alleged recovery is false and there is no independent witness of the said recovery. The applicants are not the owner of the vehicle. It is also pointed out that the applicants have no criminal history and are in jail since 31.1.2021. In case, the applicants are enlarged on bail, they will not misuse the liberty of bail.
Learned A.G.A. has opposed the prayer for bail but could not dispute the aforesaid facts.
Perused the first information report as well as the averments made in the bail application.
Considering the facts and circumstances of the case and also perusing the material on record, without expressing any opinion on the merit of the case, let the applicants Rajveer, Ramesh Banjara and Jagdish Banjara involved in case crime no.26 of 2021, under Section 3/5A/8 of U.P. Prevention of Cow Slaughter Act and under Section 11 D Prevention of Cruelty to Animals Act, P.S. Sajeti, District Kanpur Nagar be released on bail on their furnishing a personal bond and two local sureties each of the like amount to the satisfaction of court concerned on the following conditions that:
1. the applicants shall not temper with the prosecution evidence.
2. the applicants shall not pressurize the prosecution witness;
3. the applicants shall appear on each and every date fixed by the trial court.
In case of default of any of the conditions enumerated above, the order granting bail shall automatically be vacated.
