A preliminary objection raised by Sri Kaushalendra Nath Singh appearing for the respondent no. 3, is that this is a second writ petition for the same cause of action. Earlier Writ Petition No. 9401 of 2018 was disposed of vide order dated 14.3.2018 by this Court with a direction to the Authority concerned to decide the application made by the petitioners for regularisation of their plot under the provisions of the NOIDA Rural Abadi Site (Management and Regularization for Residential Purposes) Regulations, 2016 and thus this petition merely by moulding the relief, is not liable to be entertained.
When confronted with the aforesaid objection, learned counsel for the petitioners sought prayer to permit withdrawal of the writ petition.
Sri Kaushalendra Nath Singh has no objection to the prayer being granted.
The writ petition, accordingly, stands dismissed as not pressed.
