Following substantial questions of law arise for consideration of this Court: "Whether lower appellate court was correct in decreeing the suit without getting the survey done of land in dispute. In the absence of survey land could not have been identified?
Whether the lower appellate court was correct in placing reliance on the report of Advocate Commissioner to hold that the land in dispute is part of plot No.1065/2 Whether the decree passed by trial court could have been set aside by lower appellate court without considering and discussing the reasons given by the trial court for dismissing the suit filed by plaintiff-respondent? " Counter affidavit may be filed within six weeks. Rejoinder affidavit may be filed within two weeks thereafter. List after the expiry of the aforesaid period.
