Heard Sri Mohd. Ayub, learned counsel for the petitioner, learned Standing Counsel for the respondent nos.1 to 3, and Sri Manoj Nigam, learned counsel for the respondent no.4.
Learned counsel for the petitioner states that the impugned auction notice dated 29.01.2019 has been issued by the respondent-Bank against the petitioner to the tune of Rs.3,61,552/-. He further states that the petitioner is ready to deposit the dues in easy instalments.
Sri Manoj Nigam, learned counsel for the respondent-Bank has no objection in accepting the amount in easy instalments.
Accordingly, this Court fixes four equal monthly instalments for the petitioner. The first instalment will become payable on 11th of July 2019 and the rest three instalments will be paid by the petitioner on the 11th day of each succeeding month.
In case, the petitioner deposits the amount in instalments as stated above, no coercive measures regarding auction may be taken against the petitioner.
Failure to deposit any instalment within time as stated above, will leave it open to the respondents to proceed in accordance with law.
With the aforesaid observations, the writ petition stands disposed of. No costs.
