Heard learned counsel for the petitioner and Sri J.S. Bundela, learned Standing Counsel for respondents.
The petitioner was engaged as Meth in Lok Nirman Vibhag, Mainpuri on 26.06.1985 and thereafter, he was inducted as work charged employee and his services were regularized on 14.08.2006. The petitioner has retired on 31.12.2020.
Learned counsel for the petitioner has relied upon the judgement of Apex Court in the case of Prem Singh Vs. State of Uttar Pradesh and Others 2019 (10) SCC 516 to contend that petitioner is entitled to be added the length of service rendered by him as work charged employee for the purpose of computation of pension and other benefits.
The petitioner in this respect has submitted a representation to respondent no.4-Executive Engineer Provincial Division Lok Nirman Vibhag, Mainpuri on 31.05.2018, copy of which is annexed as annexure 6 to the writ petition.
The grievance of the petitioner is that neither his representation has been considered by respondent no.4 nor he has been granted pensionary benefits.
Learned Standing Counsel submits that no useful purpose would be served in keeping the writ petition pending and appropriate direction may be issued to respondent no.4 to consider the grievance of the petitioner.
Considering the facts and circumstances of the case and without going into the merits of the case and with the consent of the parties, the writ petition is disposed of permitting the petitioner to file a fresh representation before the respondent no.4- Executive Engineer Provincial Division Lok Nirman Vibhag, Mainpuri raising all his grievances within a period of three weeks from today. In case any such representation is filed by the petitioner, the respondent no.4 shall consider and decide the same in the light of judgement of Apex Court in the case of
Prem Singh (supra) by reasoned and speaking order within a period of four months thereafter.
The writ petition is disposed off subject to the observations made above.
