Heard learned counsel for the applicant and Sri Neeraj Upadhyay, learned Additional Chief Standing Counsel.
The only fetter which exists in the consideration of the claim of the applicant for voluntary retirement is a direction issued by this Court in independent proceedings requiring the applicant to pay Rs.5,000/- per month as maintenance to his estranged wife. Learned counsel for the applicant states that the applicant shall continue to pay Rs.5,000/- per month to his estranged wife even if he is granted voluntary retirement.
Sri Neeraj Upadhyay states that in case such an undertaking is given by the applicant before the competent authority his claim for voluntary retirement shall be considered and disposed of with expedition in light of the statement made and recorded above.
Consequently, nothing further survives in the petition which shall stand disposed of.
