JUDGMENT / ORDER

A suit for cancellation of sale deed being suit No.393 of 2009 was filed by the petitioner and is pending before the Civil Judge (JD), Gautam Budh Nagar. In the said suit written statement etc. has been filed and issues have been framed and the matter is pending at the stage of final hearing and is not being decided.
The writ petition is disposed of with the observations that the court below may consider and decide the suit in accordance with law without granting unnecessary adjournment to either of the parties provided there is no other legal impediment in the same, inasmuch as no interim order is operating against the disposal of the said case.
